This document contains important information about your domain name registration and the services we provide with it.
Please read it as you are agreeing to be bound by these terms and conditions when you register a domain name through us.

All customers agree to be bound by the following:

Warranty

The web space and email service is provided free of charge and without warranty.
See Limitation of Liablity (below).

Description of the service

We provide 10MB of free web space and one email account when a customer registers a domain name.

This is a basic web hosting service. We do not provide Microsoft Frontpage extensions, PHP or allow the running of CGI scripts on these accounts.

The free web space is automatically withdrawn if you change the name servers to those of another web hosting company. Once the web space has been withdrawn it can not normally be reactivated.

The 10MB of free space can not be transferred to any other hosting account supplied by any of our other brands. This means that if you order an annual or monthly web hosting plan from us you can not decide later to return to the free web hosting.

Domain registration

When a customer orders a domain name from us we will take all reasonable steps to ensure it is registered in a timely manner. However, we make no guarantee that the domain name will be registered. For example, the domain name may already be registered; it may of an unathorised type or the customer may not be eligible to register that type of domain name. If the registration fails we will make a refund of the full registration fee. Customers are advised to check that the domain name has been registered correctly via whois or by looking for the holding page we put up for each domain name.

Domain ownership

We register all domain names in the customers name, with them being listed as registrant and administrative contact.

If we terminate the free web hosting supplied with the domain name for a breach of these terms and conditions, the domain name shall still be registered to the registrant and they will be entitled to change its name servers to those of any other web hosting company.

Domain renewal

6 weeks before the renewal of the domain name we will send an email to the address you gave when you registered the domain name. This email will have full instructions and a link to our renewal system. If the domain is not renewed we will send a further email each week until the domain name expires.

If the domain name expires we will remove the free web hosting for it and it will be released for public registration.

You must provide us with an up to date mail address at all times. Some customers have found that their domain names have expired and been bought legitimately by third parties due to them not renewing. If this happens there is nothing we (or anyine else) can do to help you.

Nameroute.com / Hostroute.com Ltd will not be held liable for the loss of any domain due to non renewal. The renewal date is determined by you when you register, so if you have registered a domain name for 2 years you have had 2 years notice that it is due for renewal.

Content

Pornography and sex-related merchandising is prohibited on all Nameroute.com servers. This includes sites that links to such content.

If you are unsure whether or not your site falls into this category feel free to contact us with a description before signing up for an account or publish material as an existing customer.

Nameroute.com will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Nameroute.com servers or any other server on the internet.  Links to such materials are also prohibited.

Examples of unacceptable content or links:

• Pirated software.
• Pornography and sex-related merchandising.
• Violations of Copyrights.
• Hacker programs or archives.
• Warez sites.
• Hate propaganda.

Nameroute.com will be the sole arbiter as to what constitutes a violation of  this provision.

MP3 and other music files

We do not allow the storage or distribution of MP3 files containing copyrighted music.
You may distribute MP3 files of music you have created.

Unsolicited Commercial E-mail (SPAM)

Spamming, or the sending of unsolicited email, from a Nameroute.com server or using an email address or domain that is maintained on an Nameroute.com machine as reference is STRICTLY prohibited. Any sites using spam or selling of spam related software or bulk email content will be closed. SPAM also includes the posting of unsolicited e-mails or newsgroup postings to gain publicity for your web site hosted on our servers.

Nameroute.com will be the sole arbiter as to what constitutes a violation of this provision. 

Spamming WILL get your account terminated without notice.

Refunds

There is no money back guarantee with the domain names package.
By ordering a domain name from us you agree that no refund will be given should you change your mind or mis-spell the domain name you wish to register.

Buying a domain name is a serious contractual obligation
so please think about it carefully before placing an order.

Back ups

It is your responsibility to keep backups of your web site and restore them if you damage or lose part of your web site.

Server Abuse

Any attempt to undermine or cause harm to a server, or customer, of Nameroute.com is strictly prohibited. Offenders will be prosecuted to the fullest extent of the law.

Refusal and withdrawal of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion.
This is a free hosting service provided to people who purchase a domain name from us. We reserve the right to withdraw such free services at any time.

Correspondence

In the event of written notification of account termination being sent by Hostroute.com Ltd to a customer, any such communication sent by normal post shall be considered received by the customer.

Threats & Blackmail

In the past some customers have believed that they can leverage free services or a higher level of support if they make threats against Nameroute.com or its staff.

For example: we do not provide support with building of web sites but we have been threatened by customers that if we don't build their web site for them they will seek to harm our business.

We take threats and blackmail very seriously.
Making threats will result in your account being cancelled without notice.

Here are some examples of previous customer threats that we find unacceptable:

1. Threatening to post defamatory remarks about Nameroute.com to newsgroups or public bulletin boards if we do not expedite a support request, provide additional services free of charge or otherwise treat you differently from all other customers.

2. Threatening to ask your credit card company for a refund if we do not expedite a support request, provide additional services free of charge or otherwise treat you differently from all other customers.

3. Threatening to disrupt the operation of our network(s) or servers if we do not expedite a support request, provide additional services free of charge or otherwise treat you differently from all other customers.

4. Mailbombing: sending of multiple duplicate enquiries before we have had a reasonable opportunity to respond to the first one.

Limitation of liability

Your use of Nameroute.com's services are at your sole risk.  All  Nameroute.com services are provided on an "AS IS" basis WITHOUT  WARRANTIES OF ANY  KIND, EITHER EXPRESS,IMPLIED, CONSTRUCTIVE, OR STATUTORY, INCLUDING,WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY,  NON INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you in full. 

Nameroute.com makes no guarantee of availability of service and reserves the right to change, withdraw, suspend, or discontinue any functionality or feature of the Nameroute.com service. 

IN NO EVENT WILL Nameroute.com  BE LIABLE FOR ANY
DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT,
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR
PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR 
INABILITY  TO USE Nameroute.com's  SERVICES OR ANY
CONTENT THEREON. THIS DISCLAIMER APPLIES, WITHOUT 
LIMITATION, TO ANY DAMAGES OR INJURY, WHETHER FOR
BREACH OF CONTRACT, TORT, OR OTHERWISE, CAUSED BY
ANY FAILURE OF PERFORMANCE; ERROR; OMISSION; 
INTERRUPTION; DELETION; DEFECT; DELAY IN OPERATION OR
TRANSMISSION; COMPUTER VIRUS; FILE CORRUPTION; 
COMMUNICATION-LINE FAILURE; NETWORK OR SYSTEM 
OUTAGE; OR THEFT, DESTRUCTION, UNAUTHORIZED ACCESS 
TO,  ALTERATION OF, OR USE OF ANY RECORD.

The formation, construction and interpretation of this agreement shall be controlled by  the laws of Scotland. The U.N. Convention of Contracts for the International Sale of Goods is expressly excluded from any interpretation of this Agreement.

Any dispute relating to this agreement shall be subject to the exclusive jurisdiction of the courts in Edinburgh, UK, and the parties agree to submit to the personal and exclusive jurisdiction and venue of these courts.

Nameroute.com reserves the right to change or amend these Terms of Service at any time without prior notice. By submitting your order  to Nameroute.com, you signify your agreement to these Terms of Service. 

If you do not agree to these Terms, then please don't submit an order!
 

Violations of these Acceptable Uses Policies and Terms of Service should be referred to (abuse at hostroute.com).

All complaints will be investigated promptly.

Serious violations of terms or conditions can be ground for immediate account deactivation without refund.
